In November 21, 2017, the European Union issued a new "directive 2017/2102" in the official gazette, which was used to revise the scope of directive 2011/65/EU (RoHS 2 directive). RoHS 2 directive restricts the use of certain hazardous substances in electrical and electronic equipment.
The new directive focuses on the operation of the second market for electrical and electronic equipment, including repairs, parts replacement, renovation, reuse and renovation. EU legislators believe that there is a need to assist the operation of these second markets in order to promote the "recycling economy". "Circular economy" is a new concept in recent years to extend the added value of the product as much as possible. Even if the product has reached the end of life, they can still reuse these products or their parts to reduce waste.
The RoHS 2 directive allowed the non regulation of directive 2002/95/EC (RoHS 1 instruction), but it did not comply with the continued delivery of electrical and electronic equipment stipulated in directive 2011/65/EU (RoHS 2 directive) until July 22, 2019. Electrical and electronic devices violating RoHS 2.0 will be banned from the market for the first time or for the second time after that date. However, EU legislators now believe that the prohibition of the operation of the second market is not in line with the general principles behind the relevant EU measures, including the circular economy, and therefore should be considered again.
Therefore, the new instruction sets out that if the audited closed loop enterprise reuses the enterprise recycling system and the consumer also learns that the parts are used again, the restriction of the RoHS 2 instruction to the harmful substances will not apply to the reusable parts of the following cases:
(a) Electrical and electronic equipment from which the parts were put on the market before 1 July 2006 and for which they were put on the market before 1 July 2016;
(b) the parts came from medical equipment or monitoring and control instruments launched before July 22, 2014 and used in electrical and electronic equipment to be put in the market before July 22, 2024.
(c) The parts are from in vitro diagnostic medical equipment which will be put on the market before July 22, 2016, and will be used for electrical and electronic equipment which will be put on the market before July 22, 2026;
(d) Components from industrial surveillance and control instruments put on the market by 22 July 2017 and used for electrical and electronic equipment put on the market by 22 July 2027;
(E) the parts come from the market, all other electrical and electronic equipment that are not within the scope of the RoHS 1 command regulation before July 22, 2019, and are used for electrical and electronic equipment to be put in the market before July 22, 2029.
Be careful:
Some of the non mainstream products have been excluded from the RoHS 2 directive, including equipment or photovoltaic panels for space use. In addition, pipes in the organ are made of a particular lead based alloy, and so far there is no substitute; most of the pipe organs have been placed in the same place for centuries, and the circulation rate is as low as nearly zero. Therefore, the pipe organ is also excluded from the RoHS 2 command gauge, because even if the regulatory range includes the pipe organ, the effect of replacing lead is negligible.
The RoHS 2 directive also does not apply to non road mobile machinery with built-in power supply, which has its special professional use. However, there are two versions of some off-road mobile machines, both made in the same line, and the only difference is whether the power supply is built-in or external. Under the instruction of RoHS 2, the two versions must be processed in the same way. Therefore, the traction drive system by external power supply of non-road mobile machinery, must also be excluded from the RoHS 2.0 directive range.
Directive No. 2017/2102, which amended the RoHS 2 directive, will take effect twentieth days after the promulgation of the official gazette. The EU member states are required to implement the legislation, regulations and administrative provisions in compliance with Directive 2017/2102 by June 12, 2009 at the latest.
